Prayagraj District Court has issued a notice to the Prime Minister’s Office over a plea filed against Prime Minister Narendra Modi for wearing an Indian Army uniform during his Kashmir visit last year.

After hearing submissions by advocate Rakesh Nath Pandey, District judge Nalin Kumar Srivastava issued the notice. Advocate Pandey had moved an application under Section 156(3) of the Code of Criminal Procedure (which empowers Magistrate to order investigation into a cognizable offence).

The complainant had submitted that PM Modi was seen wearing an Indian Army uniform during an address in Nowshera, Kashmir. He submitted that it is an offence under Section 140 (wearing garb or carrying token used by soldier, sailor or airman) of the Indian Penal Code.

Reportedly, Pandey’s application was rejected by Chief Judicial Magistrate Harendra Nath on December 21, 2021. CJM rejected the application citing the reason that the incident didn’t take place within the jurisdiction of the court and the matter can be heard by a Magistrate having jurisdiction.

Advocate Pandey challenged the order before the District Court which has issued a notice to the PM Office.
