Supreme Court has dismissed a criminal writ petition filed against Bharatiya Janata Party spokesperson Sambit Patra and ABP News alleging that they have hatched a conspiracy against the farmers to implicate them as hooligans and terrorists by running fake news and propaganda.

The petition was filed by Advocate Manohar Lal Sharma stating that a person cannot be alleged as a terrorist out of the definition as provided under the law. He further submitted that therefore the empty handed farmers cannot be called terrorists.

“The allegations are false and all actions based under so-called allegations are illegal and persons alleged said are liable to be prosecuted u/s 182 and 211 of IPC,” stated the petition.

Advocate Sharma had sought directions to the Centre government to direct National Investigation Agency (NIA) to register an FIR against Sambit Patra, ABP News, and others under Section 211 and Section 182 of Indian Penal Code read with Section 120-B & Section 107 of IPC.

The petitioner had asked the court to prosecute them in accordance with the law for declaring false allegation and filing false FIR with National Investigation Agency against innocent farmers under false concocted conspiracy hatched by them to fix them under criminal conspiracy to abuse them as terrorists for their political object by derailing farmer protest against farmer bills.

The petitioner has also attached the annexed photos that were clicked on the Republic Day during the Kisan Tractor Rally where it was alleged that protesting farmers removed the Indian national flag from the Red Fort and hoisted their religious flag there.

He presented the different images wherein it can be clearly seen that no one hoisted their religious flag at Red Fort.

The petitioner had also raised the issue that no one telecasted the Tractor Rally and no farmer was having any weapon or arm explosive. “The Delhi Police have not made such an allegation so far. How can an empty-handed farmer be called a terrorist? What reporters and BJP spokespersons have been shouting on each TV channel and press that these are not farmers, they are terrorists,” advocate Sharma said.
