In a new twist to the 7-long years of Nirbhaya gangrape, one of the four death row convicts in the case, Mukesh has moved Supreme Court on Friday, seeking for the restoration of his legal remedies, alleging fraud by his lawyer.
The plea filed through the advocate M L Sharma has sought for a CBI probe into the alleged ‘criminal conspiracy’ and ‘fraud’ hatched by the Centre, Delhi government and the amicus curiae in the case Advocate Vrinda Grover, who entered into a “criminal conspiracy.”
“Petitioner (Mukesh) is a victim of criminal conspiracy and fraud played by the three respondents, i.e. Ministry of Home Affairs, Delhi government, and Vrinda Grover. He was obliged to sign various papers under a threat that the session court has directed her to secure various signed documents from him (which was never directed by the session court) to file various petitions, including the curative petition, on his behalf in the high court and the Supreme Court in his death sentence case,” stated the plea.
The petition also claimed that the limitation period to file a curative petition was three years, from the date of dismissal of the review plea and has sought to ‘restore’ the rights available to Mukesh, further allowing him to file curative and mercy petitions until July 2021.
The said plea for restoration of legal remedies was filed, just a day after the Delhi’s Patiala House Court has issued a fresh death warrant to the convicts, on Thursday.
As per the fresh death warrant, all the four death row convicts namely Vinay Sharma, Mukesh, Akshay, and Pawan Gupta are scheduled to be hanged at 5:30 AM on 20 March.
Earlier, the curative petition of the convicts, Vinay Sharma, Mukesh, Pawan Gupta, and Akshay was dismissed by the Supreme Court and subsequently, their mercy petition was also dismissed by the President.
