Supreme Court on Thursday stayed the Kerala High Court order barring aided school teachers and non-teaching staff from contesting Assembly elections. The final date of submission for the nomination was March 19, 2021.
Senior Advocate V Giri, appearing for petitioner appealed before the court that the order needs to be stayed today as the final date for the submission of nomination is tomorrow.
The stay order was issued by a bench headed by CJI S A Bobde, also comprising Justice AS Bopanna and Justice V Ramasubramanian. The bench has also issued a notice.
Kerala High Court had restricted the aided school teachers from political activities and contesting assembly polls over multiple PILs filed seeking directions to restrict the aided school teachers to contest the assembly elections.
In the order, High Court held that inter alia that a teacher of an aided educational institution, within the State of Kerala, is a person holding an ‘office of profit’ under the Government of the State of Kerala and is thus disqualified from contesting in the elections to either the Parliament or the State Legislature.
