A court in Uttar Pradesh has ordered a woman to pay monthly maintenance of Rs 1,000 to her husband and allowed the petition filed by her husband.
The woman is a government pensioner and has been living separately from past many years. The man had filed a petition seeking maintenance under Hindu Marriage Act, 1955.
The family court judge has allowed the petition of the husband and ordered the wife to pay Rs 1,000 to the petitioner every month. The woman was a government servant and now is retired and receiving pension worth Rs 12,000 every month.
Husband is also entitled to get maintenance under Section 25 of the Hindu Marriage Act, 1955 in the specific cases where the husband is incapable of maintaining himself. There is no such provision under the Special Marriage Act, 1954. Only the woman is entitled to maintenance.
