Supreme Court has denied the bail application of peasants’ rights activist Akhil Gogoi who is lodged in jail since December 2019 in connection to his alleged involvement in the violent CAA protests in Assam. Activist Gogoi had challenged the Gauhati High Court order rejecting his bail plea.

A three-judge bench of Justice NV Ramana, Justice Surya Kant, and Justice Aniruddha Bose rejected the bail petition while saying, “We will not consider the petition at this stage.”

Senior Advocate Jaideep Gupta, appearing for Gogoi submitted that a large-scale agitation had taken place in protest against Citizenship Amendment Act and its not related to terrorism at all.

He further submitted that there were some instances where there was violence at some places but there is no evidence that the petitioner was responsible. It does not amount to an act of terrorism on a prima facie basis.

“Cannot consider bail in light of the allegations as of now. Maybe later, you can file an application,” said Justice Ramana.

“Let the trial proceed. Courts have started functioning now,” added Justice Surya Kant.

Gauhati High Court rejected the bail plea of Akhil Gogoi on January 7, 2021 in connection to one of the 13 cases registered against him.He was denied bail in connection to a case registered under Section 120B, Section 124A, and Section 153B of Indian Penal Code, and Section 18 (Punishment for conspiracy, etc.) and Section 39 (Offence relating to support given to a terrorist organisation) of UAPA Act.
