A Session Court in Dindoshi has granted bail to a 36-year old man who was accused of raping his live-in partner. The bail was granted on the ground that the facts prima facie show that they were in a consensual relationship.
The woman had filed a complaint in the Juhu police station. She had complained that he had administered a stupefying substance to her. She had also alleged that he had raped her and taken intimate photos and videos of her. The complainant woman had also accused the man of causing an injury to her.
“Factual scenario prima facie shows the existence of the consensual sexual relationship between the applicant and the informant. Regarding the fracture injury, the court noted that she had lodged a complaint about it a year after the injury was caused,” said Additional Sessions Judge SU Baghele.
The bench also took note of the woman’s FIR as per which the couple had a love affair in 2013 after which they developed sexual relations with each other.
The advocate representing the man submitted that allegations posed by the woman were false. She sustained those injuries in an accident.
He also mentioned that the two had a financial dispute. The woman allegedly filed a counter-complaint to his complaint.
