The Delhi Metropolitan Magistrate court dismissed the bail plea of 15 persons who were detained on the night of 20 December, for their alleged involvement in the violence at Daryaganj area in Delhi. The court further extended their judicial custody by two weeks.
Dismissing the bail applications, the Magistrate Kapil Kumar cited the seriousness of the allegations and pendency of the investigations and said that there was no sufficient ground to grant them relief.
Daryaganj Police station registered an FIR against the detainees citing Sections 147, 148, 149, 186, 353, 332, 323 and 436 of Indian Penal Code, and Sections 3 and 4 of Prevention of Damage to Public Property Act.
The Senior advocate Rebecca John, appearing on behalf of the detainees argued that the accused should not be kept behind bars since police did not have CCTV footage or any other evidence against them. She further stated that “Section 436 (mischief by fire or explosive substance with intent to destroy a house, etc.) of IPC does not apply. Do they have any proof, CCTV footage, etc. against them?”
