Delhi High Court on Wednesday, has asked the Magisterial court to examine the plea thoroughly and pass an order on the plea filed by CPI(M) leader seeking registration of FIR against the two BJP leaders, Anurag Thakur and Parvesh Verma, alleged of giving hate speeches during the CAA protests.
Delhi HC bench of Chief Justice D N Patel and Justice Prateek Jalan has issued the directions after Karat’s counsel had made a request to dispose of the matter and ask the magisterial court to decide on her petition.
Counsel representing Brinda Karat told the bench that magisterial court had heard the matter on February 26 and reserved the judgment after hearing both the sides. But the court has not announced the order as the matter is pending before High Court.
Following the request made by CPI(M) leader Karat, Delhi HC has disposed of the matter by asking the magisterial court to “decide her application in accordance with law, rules, regulations and government policy applicable to the case and as expeditiously as possible and practicable”.
In addition to the Karat’s plea, the bench was also hearing several other petitions seeking actions against other leaders who gave hate speeches including BJP leaders (Kapil Mishra, Abhay Verma), Congress leaders, (Rahul Gandhi, Sonia Gandhi, Priyanka Gandhi Wadra), and AAP leaders (Manish Sisodia, Amantullah Khan), and AIMIM MLA Waris Pathan during CAA protests and following Delhi riots.
The petitioners are seeking various reliefs through their pleas including the setting of a Special Investigation Team (SIT), FIRs against the police officers who were involved in the violence, and also seeking the disclosure of the persons arrested and detained during the whole period.
