Delhi Court on Wednesday rejected the bail application of Shahrukh Pathan who had openly pointed a pistol on a police constable during the violent northeast Delhi riots in February. The bail plea was dismissed after his counsel withdrew the petition.
Justice Suresh Kumar Kait heard the matter through video conferencing and said, “If you take law in your hands and become a hero, then you have to face the law. Your intention was to become a hero.”
Advocate Asghar Khan representing Shahrukh had sought the bail citing the reason to take care of his 76-year-old father who is unwell. Asghar stated that the accused is in custody from the last 113 days and should be released as there are no criminal antecedents and his requirement in the investigation under the charge sheet filed. Shahrukh’s counsel also cited the example of Saffora Zargar who was granted bail on Monday on the basis of humanitarian grounds.
Opposing the plea, Additional Public Prosecutor Amit Chadha stated contended that they have got ample evidences against the accused. There are two CCTV footages where Shahrukh can be seen firing.
Mentioning the ground of granting bail plea to let the accused take care of his father, the judge noted, “he should have thought about his family when he was brandishing a pistol. While committing the offence, you forget everyone and now you are thinking about your aged and ailing parents.”
During the Delhi riots erupted amid CAA protests, a photo and video of 23-year-old Shahrukh Pathan went viral over the internet in which he was pointing a pistol at an unarmed police constable Deepak Dahia. A case had been registered by police against Shahrukh and he was booked under Indian Penal Code and Arms Act.
