Netflix series Suits inspired Sessy Xavier gets no relief as Kerala High Court has denied anticipatory bail to her. She was accused of impersonating herself as a lawyer without a law degree.

She attempted to surrender before the Magistrate court in Alappuzha but later fled the courtroom after she came to know that she has been charged with non bailable offences.

An FIR has been lodged against her under Section 417 (cheating), Section 419 (Cheating by impersonation) and Section 420 (Cheating and dishonestly inducing delivery of property) of Indian Penal Code.

The FIR stated that Sessy Xavier by providing roll with No K 1177/2018, which is the roll number of an advocate practising in Thiruvananthapuram, acted as an advocate before the litigant and before the court.

Loopholes In The System

Sessy was practicing as an advocate for the last two and half years. She contested and won the librarian post in the District Bar Association. She earned a good reputation after appearing in several court cases and had recently made the front page for posing as an advocate. She was also appointed an advocate commissioner in several matters.

And she did all that without a law degree!

That was a complete shock for the lawyers of Kerala’s Alappuzha Session Court who have worked with her for over two years.

Anonymous Letter Unveiled The Truth

On July 15, Bar Association received an anonymous letter alleging that Sessy didn’t possess an LLB degree or an enrollment certificate. Taking note of the allegations, Kerala Bar Council asked her to submit her documents which she failed. Following which a police complaint was filed. Sessy allegedly fled several rare books and documents from the library.

Sessy was a law student but she allegedly failed to clear the exam due to short attendance. She approached a senior lawyer for an internship and returned to him again after a couple of months claiming that she completed her law degree and want to work under him.

Anticipatory Bail by Sessy Xavier

Anticipatory bail plea filed through advocate Roy Chacko stated, “Due to the poor financial circumstances at home, she could not complete her course. Instead, she joined as a law intern in an advocates office at Alappuzha. She attended the office of the advocate and attended the courts regularly at Ramankary and Alappuzha, wearing a coat, without advocate’s gown.”

“Even though she has not been a member of the Bar Association, her nomination for the election of Bar Association was accepted and she also won the election. After she won the election, her friends, who had ill-advised her to contest in the election, gave publicity about her non-completion of the law degree and non-enrollment with the Bar Council of Kerala,” advocate Roy submitted.
