Recently launched “Coronil” drug by Ramdev’s Patanjali which was claimed to be a cure for COVID-19 has encountered another blow as Madras High Court has restrained the company from using the trademark “Coronil”. The interim order is valid until July 30.”

Justice CV Karthikeyan took the decision while hearing a plea filed by Chennai-based company Arudra Engineering Private Limited which claimed that they own the trademark “Coronil” since 1993.

The petitioner stated that the company manufactures sanitizers for cleaning machinery and containment zones. The company has registered ”Coronil-213 SPL” and ”Coronil-92B” in 1993 and has been renewing the trademark subsequently. The trademark is currently valid till 2027.

Arudra Engineering Private Limited stated that the trademark is globally recognized. “Permitting Patanjali to continue to use the mark will directly affect our reputation and the goodwill created over the mark for over 26 years in both international and domestic markets,” said the petitioner.

“The mark adopted by Patanjali for its drugs are clearly identical to the marks registered by the company. Though the products sold by the company are different, use of identical trademarks would still amount to infringement of our intellectual property right,” added the company. The company has also shown the sales bills for the past five years.

Earlier on July 1, AYUSH Ministry has allowed the Yoga Guru Baba Ramdev’s Patanjali Ayurved Ltd to sell the Coronil drug as an immunity booster instead of marketing it as a medicine to cure COVID-19.
