A lawyer in Ratlam, Madhya Pradesh has been in jail since February 9 for allegedly sending indecent birthday wishes to the Judicial Magistrate First Class (JMFC) in the district by e-mail on January 28 at 1.11 am. He has been booked under relevant Sections of Indian Penal Code and Information Technology Act.
The 37 years old accused, Vijay Singh Yadav who is a lawyer by profession, allegedly downloaded a picture of JMFC from her Facebook account without obtaining her consent and sent it to her in the form of a birthday greeting along with an “indecent message”. It was also alleged that he sent a greeting card to JMFC through a speed post the next day.
An FIR was lodged by Mahendra Singh Chouhan, System Officer, Ratlam District Court on February 8. In the complaint, Yadav has been accused of cheating, forgery, and forgery for the purpose of harming reputation, and relevant Sections of the IT Act.
Yadav’s brother told that Yadav is contending his case himself. A lower court denied his bail plea on February 13. Now the family has moved the Indore bench of the Madhya Pradesh High Court to seek bail. The High Court has scheduled the case hearing for tomorrow, i.e. March 3.
In the bail petition filed by Yadav, he cited a separate complaint against the JMFC before the Chief Judicial Magistrate (CJM). In his defence, he submitted that he sent the birthday greetings as a social worker and president of Jai Kul Devi Sewa Samiti, Ratlam. He further added that he had downloaded the image from google and used it as a creative designer.
