Mukesh Singh, one of the four death row convicts in the Nirbhaya gangrape and murder case has now sought to stay his death sentence claiming that he was not in the National capital on the day of the crime.

The bench headed by Additional Sessions Judge Shri Dharmendra Rana has reserved the order on the application filed by the convict Mukesh, through his lawyer ML Sharma, who has now sought to declare the trial as vitiated alleging concealment of material documents and facts.

“Mukesh said that he was arrested from Ravidas camp, not from Karoli. While PW-58 SI Arvind Kumar disclosed that they went to Karoli by private car, visited Karoli police station and apprehended Mukesh from Karoli and returned to Delhi. Due to non-filing, Mukesh was implicated in this case despite being innocent,” the application argued.

Earlier, on Monday, Mukesh’s plea seeking restoration of all his legal remedies alleging that his earlier lawyers misled him, was rejected by the apex court.

On 16 March, the other three convicts in the case Akshay Thakur, Pawan Gupta, and Vinay Sharma have reportedly approached the International Court of Justice (ICJ), seeking a stay on the execution of their death sentence.

As per the fresh death warrant, all the four convicts Mukesh, Vinay, Pawan, and Akshay are scheduled to be hanged on 20 March at 5:30 AM.
