After taking suo moto cognizance, Cyber Crime Cell of Vadodara police has detained Youtuber Shubham Mishra on Sunday evening, alleged of making “open rape threats” against stand-up comedian Agrima Joshua in his video.
“Vadodara City Police took suo moto action in respect of an abusive, threatening video which was uploaded and shared on Social media by Shubham Mishra. We have detained him and initiated legal process for registration of FIR against him under the relevant section of IPC and IT act,” tweeted Vadodara city police.
An FIR has been registered against Shubham under the Section 294 (obscenity), Section 354 (A), Section 504 (intentionally insults to break public peace), Section 505 (statements conducing to public mischief), Section 506 (criminal intimidation), and Section 509 (intending to insult the modesty of a woman) of Indian Penal Code. He is also booked under Section 67 (Transmission of electronic material which is lascivious or tends to deprave or corrupt people) of the Information Technology Act.
On Saturday, 26-year-old Shubham Mishra uploaded a video on his Instagram account in which he can be heard making derogatory remarks against Agrima Joshua commenting over her video on Shivaji’s statue in Maharashtra.
Agrima Joshua’s stand-up comedy video went viral in past three days which is over a year old. After receiving a huge censure over the social media and taking note of the Maharashtra home minister Anil Deshmukh’s directions to take legal action against her, she removed the video and even apologized.
Then on Saturday, Shubham Mishra posted a video hurling abuses on Joshua on his personal account having more than 35,000 followers.
The action is also based on the letter written by the National Commission for Women (NCW) to Gujarat’s Director General of Police Shivanand Jha. “The NCW is committed to creating safe online space for women and ensuring cyber security to women and is perturbed by the rise in use of cyberspace to instigate crime against women,” stated Rekha Sharma, NCW chairman.
Shubham Mishra later deleted his video and apologized for his abusive language and derogatory remarks against the woman following the huge outrage over social media platforms.
