Punjab and Haryana High Court dismissed a protection plea filed by a married woman who is residing with another man without divorcing her husband. The court has imposed a cost of Rs 25,000 on the petitioner.

The bench of Justice Manoj Bajaj called it an ‘unholy alliance’ and ordered the petitioners to deposit Rs 25,000 with District Legal Services Authority, Patiala.

Petitioner number1, Sonu married Gurjit Singh (Respondent number 4) and out of this wedlock they both had three children.

In the past six months, petitioner number 1 came in contact with petitioner number 2, namely Sukhwinder Singh and fell in love with him. Sukhwinder Singh is a widower who has no child from his first marriage. The time when the private respondents came to know about their relationship and raised objections against the alliance, the petitioners decided to reside together.

Both the petitioners filed a representation before Senior Superintendent of Police, Patiala where no action was taken. Apprehending that the private respondents would cause harm to them, the petitioners then filed an instant protection plea before Punjab and Haryana High Court.

The court observed that the Woman, who is already married, has now entered into relations with petitioner No.2 without dissolution of marriage.

“The petitioner No.1 has entered into (an) unholy alliance with the petitioner No.2 and the petition is based on bald averments without any supportive material. Since the petitioners have filed this petition without a valid and convincing cause of action, therefore, the petitioners deserve to be burdened with costs,” stated the court.
