A Delhi court on Monday discharged former BJP MLA Kuldeep Singh Sengar and five other accused in connection to the Unnao rape survivor accident case. However, the court found sufficient prima facie evidence against the four other accused and will award their sentence on Tuesday.
In the 2019 Unnao Rape Survivor car accident case, the victim and her lawyer had sustained injuries and two of her aunts died on the spot.
“No prima facie evidence on record to charge Kuldeep Singh Singer regarding a criminal conspiracy to extend threat to kill the victim or her members. No charges can be framed against him,” noted Additional Chief Metropolitan Magistrate Ravindra Kumar Pandey.
“The accused Kuldeep Singh Sengar was in judicial custody during the period when the alleged threats were extended to the victim or her family members and admittedly the use of prosecution is that he conspired with the other accused persons to extend the threat to the victim or her family and he himself did not extend any threat,” said the order.
ACMM added, “However, no evidence of any nature regarding criminal conspiracy apart from oral statement of the complainant and his family members is produced or attached with the Court record.”
Besides former Uttar Pradesh BJP legislator, five of his aides — Gyanendra Singh, Komal Singh, Arun Singh, Rinku Singh, and Awdesh Singh — have also been discharged. However, the court found a prima facie case against the driver under Section 304-A (causing death by negligence), Section 338 (causing grievous hurt by act endangering life or personal safety of others) read with Section 279 (rash driving on public way) of Indian Penal Code.
They were booked under Section 506(ii) of IPC read with Section 34 of IPC.
The other four accused — Ashish Kumar Pal, Vinod Mishra, Haripal Singh and Naveen Singh — were also charged under Section 506(ii) of IPC read with Section 34 of IPC. The court has found sufficient evidence against the four accused and will frame charges against them on Tuesday.
Unnao Rap Survivor Accident Case
On July 28, 2019, a truck rammed into a car in which Unnao rape survivor, her lawyer, and two aunts were travelling from Raebareli to submit the evidence. The victim and her lawyer sustained grievous injuries while her two aunts were killed on the spot.
Uttar Pradesh police filed a case of murder against Kuldeep Sengar and none others.
Central Bureau of Investigation (CBI) also found that there was no criminal conspiracy to commit murder or attempt to murder the survivor and her family members. The investigation agency found it to be a simple case of death and injuries due to rash and negligent driving.
The rape survivor’s uncle moved a protest petition alleging the accident to be a stage-managed to prevent the survivor from giving evidence against Sengar.
He alleged that the accident was rather a deliberate act to kill the occupants of the car, which is fortified from the attempts made to deliberately tamper with the number plate and color the same in black so that the real culprits could run away.
He went on to add that in collaboration with accused Sengar and higher-ups, the CBI officials overlooked the fact that many witnesses relating to the incident and accident were threatened and coerced to give divergent statements to arrive at botched-up findings.
