Over 76 Supreme Court lawyers have written a letter to the Chief Justice of India NV Ramana, urging the Supreme Court to take suo moto cognizance of the hate speeches given during religious events in Haridwar and Delhi. The hate speeches call for ethnic cleansing and Muslim genocide.
The two separate events were organized by Hindu Yuva Vahini in Delhi and Yati Narsinghanand in Haridwar on December 17 and December 19 respectively.
Taking note of the inaction on the part of the police, the top court lawyers have made a request for judicial intervention and has sought action against guilty persons under Section 120B, Section 121A, Section 124A, Section 153A, Section 153B, Section 295A and Section 298 of the Indian Penal Code, 1860.
They have written a letter to CJi Ramana with a subject line “Prayer for taking of Suo Moto Cognizance of hate speeches calling for the genocide of Muslims given in Haridwar and Delhi”.
“This is to bring to your kind notice that between the 17th & 19th of December 2021 at two separate events organized in Delhi (by the Hindu Yuva Vahini) and Haridwar (by Yati Narsinghanand), hate speeches consisting of open calls for genocide of Muslims in order to achieve ethnic cleansing, were made,” the letter stated.

The letter further stated
“The aforementioned events and the speeches delivered during the same are not mere hate speeches but amount to an open call for murder of an entire community. The said speeches thus, pose a grave threat not just to the unity and integrity of our country but also endanger the lives of millions of Muslim citizens.
In view of the seriousness and gravity of the aforementioned events it is most humbly prayed that Your Lordship may take suo-moto cognizance of the same and direct that action be taken against the guilty persons under Sections 120B, 121A, 153A, 153B, 295A and 298 of the Indian Penal Code, 1860.
It is also pointed out that the recent speeches are a part of a series of similar speeches that we have come across in the past. It may be noted that no effective steps have been taken under the provisions of 153, 153A, 153B, 295A, 504, 506, 120B, 34 of IPC in respect of the earlier hate speeches. Thus, urgent judicial intervention is required to prevent such events that seem to have become the order of the day. We have also been informed that in this regard a few Petitions under Article 32 of the Constitution of India are also pending for consideration before the Hon’ble Supreme Court.
We are writing to your Lordship hoping for prompt action in your capacity as the head of the judicial wing of the State and knowing your Lordship’s commitment to both the independence of Judiciary as also the constitutional values that are fundamental to the functioning of a multicultural nation such as ours.”

What Action Police Has Taken In Haridwar Hate Speeches Case?
After massive public outrage, the Uttarakhand police lodged an FIR against Wasim Rizvi alias Jitendra Narayan Tyagi and others. The Uttarakhand police have added two more names.
Trinamool Congress leader and RTI activist, Saket Gokhale had also filed a complaint against speakers and organizers of the Dharma Sansad event where hate speeches were made.
“I’ve filed a complaint with SHO, Jwalapur PS in Haridwar against the #HaridwarHateAssembly conducted from 17th-20th December at Ved Niketan Dham. Failing the registration of an FIR against the organizers & speakers in 24 hrs, a plaint shall be made to the Judicial Magistrate,” tweeted Gokhale.

On Monday, Chhattisgarh police have registered an FIR against Kalicharan Maharaj for spreading enmity through derogatory words against Mahatma Gandhi and hailed Nathuram Godse for killing Mahatma Gandhi.
“Based on the complaint of Congress leader Pramod Dubey, a case was registered against Kalicharan on Sunday night at Tikrapara police station under Indian Penal Code sections 505 (2) (statements creating or promoting enmity, hatred or ill-will between classes) and 294 (obscene acts),” said the police.
No Arrests Made So Far For Muslim Genocide Speeches
Several complaints have been filed in connection to the incident but no arrests have been made so far.
Uttrakhand police refused to make any arrests in connection to the hate speeches citing the reason that their genocidal calls have not led to any violence or deaths. Uttarakhand’s Director-General of Police Ashok Kumar said that the police cannot invoke UAPA against the Hindutva leaders.
“We have invoked both Section (i) and (ii) of Section 153 A IPC in the FIR. We have to go by law, cannot invoke UAPA as the event did not lead to any violence or killing. The investigation will reveal further details,” said DGP Kumar.
