Home » News » Delhi HC rejected the convict Mukesh’s plea to stay his death warrant in Nirbhaya case


The Delhi High Court, today dismissed the plea of Mukesh – the death row convict in Nirbhaya case, who sought to stay the death warrant issued against him by the Delhi’s Patiala House Court on 7 January.

Earlier on 14 January, Mukesh Singh one of the four death row convicts in the Nirbhaya gang-rape case, filed a plea in the Delhi High Court to stay his death warrant, following his Curative petition being scrapped by the Supreme Court on 14 January. He sought the High Court to set aside his death warrant as his mercy plea was pending with the President.

The bench headed by Justice Manmohan and Sangita Dhingra Sehgal stated that there was no error in the trial court’s order which granted the four convicts death warrant and held that the present plea is like a strategy to prolong the matter. The court stated that the Supreme Court has already rejected all the appeals, reviews and curative pleas of the convicts.

“You cannot play one court against the other,” the bench asserted.

Meanwhile, the Delhi government told the High Court during the hearing that convicts’ execution will not happen on January 22, since Mukesh’s mercy plea is pending with the President.

According to the reports, Asha Devi, mother of the victim stated that “He (Mukesh) can do whatever he wants. But everything is crystal clear. The Supreme Court and the High Court know everything. I hope his request will be dismissed.”

Earlier, in 2017 the Supreme Court had upheld the capital punishment awarded to the four convicts by the Delhi High Court and a trial court.
