Patiala House Court in Delhi on Tuesday granted bail to Aumkareshwar Thakur who is accused of creating ‘Sulli Deals’ app on Github, noting that he is a first time offender and a prolonged incarceration would be detrimental to overall well being.

Chief Metropolitan Magistrate Pankaj Sharma granted him bail on the ground that the investigation in the matter was completed as the chargesheet was filed earlier this month.

The bench stated, “Merely because replies from different intermediaries and FSL is awaited, same is not sufficient reason to deny bail to the accused as accused is not position to influence FSL result or replies.”

Accused is a first time offender and a young person as such prolonged incarceration would be detrimental to his overall well being. Accused has roots in the society community and he is not a flight risk. The trial would take considerable time to save as such no fruitful purpose would be served by keeping him detained any further,” CMM Sharma added.

21 years old Neeraj Bishnoi, accused of creating another such app ‘Bulli Bai’ app on Github, was granted bail by the same court on Monday.

Both the apps were designed to target Muslim women where they were auctioning minority women as Sullis (a derogatory word used for Muslim women).

The accused were booked under Section 153A (promoting enmity on grounds of religion etc), Section 153B (imputations prejudicial to national integration), Section 295A (insulting religious beliefs), Section 354D (stalking), Section 509 (word, gesture or act intended to insult the modesty of a woman), Section 500 (criminal defamation) of the Indian Penal Code and Section 67 (publishing or transmitting obscene material in electronic form) of Information Technology Act.
