Following Supreme Court’s August 5 orders, the Bihar government has filed its reply to Rhea Chakraborty’s plea seeking transfer of FIR against her and six others from Patna to Mumbai. Bihar government has sought rejection of Rhea’s plea calling it a premature, misconceived, and non-maintainable.
“The submission of the petitioner (Rhea Chakraborty) that the entire cause of action arose in Mumbai and the State of Bihar has no jurisdiction to register FIR is liable to be rejected in view of the provisions under Section 179 of CrPC, ” stated the affidavit filed by Bihar government.
The state government has also submitted that Bihar govt has recommended the CBI investigation in the Sushant Singh Rajput death case while taking into account the sensitivity of the matter, interstate ramifications, and the presence of most of the accused in Mumbai.
Bihar government has also submitted that it has jurisdiction in the mysterious death of Sushant Singh Rajput as he hail to Bihar and his father has also filed the FIR against Rhea Chakraborty and six others in Bihar, accusing them of abetment of suicide, financial misconduct, among others.
Bihar police officials have accused Mumbai police of supporting Rhea Chakraborty and obstructing the probe. In the Bihar government’s affidavit filed through advocate Keshav Mohan stated, “The non-cooperation by the Mumbai Police with the Patna Police is clear from the fact that the former has not supplied any documents such as inquest, post-mortem, and FSL (forensic science laboratory) reports, CCTV (closed-circuit TV) footage etc; to the latter, despite several requests.”
Rhea Chakraborty had moved the Supreme Court seeking transfer of FIR filed by late actor’s father from Patna to Mumbai. Supreme Court had sought reply of Maharashtra and Bihar government along with the reply of Sushant’s father on its August 5 hearing. On the same day, centre has given nod to the CBI probe in Sushant Singh Rajput’s death case on the request of the Bihar government.
ED has also registered a case against Rhea Chakraborty and six others under PMLA and has summoned Rhea to be present for investigation on Friday. Rhea had asked ED to defer the investigation till next SC hearing which Enforcement Directorate has rejected as communicated by Satish Maneshinde, Rhea Chakraborty’s lawyer.
Another development in the case, IPS Tiwari who has been leading the Bihar investigation team has also been released to head back to Patna who was quarantined immediately on the night of his arrival in Mumbai. “BMC has informed me, through a text message, that I can go out of quarantine. I’ll be leaving for Patna now,” stated IPS Tiwari.
Meanwhile, the other four police officers have returned to Patna yesterday.
