Home » News » “Honeymoon To Hanuman Hotel”: Delhi High Court Rejected Mohammed Zubair’s Bail Plea, Sent To 1 Day Police Remand


During the late night hearing, Delhi High Court rejected the bail plea filed by the co-founder of fact-checking website Mohammed Zubair and sent him to one-day police custody remand of Special Cell’s Intelligence Fusion and Strategic Operations (IFSO).

Zubair, Alt News co-founder, was produced before Duty Magistrate Ajay Narwal of Patiala House Court at his residence in Delhi’s Burari. Delhi police has moved an application before the High Court bench seeking Zubair’s one-day remand.

The legal team representing Zubair submitted that FIR is retaliatory and the tweet is four-year-old. It was also submitted that the offence is barred by limitation also.

No ingredients are made out of 153A and 295A, and 41A CrPC notice procedure has been violated, Zubair’s legal team added.

He has been arrested under Section 153A (promoting enmity between different groups on grounds of religion, race, place of birth, language, etc) and Section 295A (deliberate and malicious act intended to outrage religious feelings) of the Indian Penal Code.

Reportedly, Delhi police received a complaint through Twitter wherein it was alleged that Mohammed Zubair had tweeted an objectionable image that deliberately insults the religious sentiments of Hindus. The image contained a screenshot from the 1983 movie “Kisi Se Na Kehna”.

The controversy revolves around a signboard which earlier contained “Honeymoon Hotel” but could be read as Hanuman Hotel after some of the text print faded away.

The complainant has the Twitter name Hanuman Bhakt, with an image of Lord Hanuman as his profile photo. The account is said to be created in October 2021.

Delhi police stated, “Such tweets were getting retweeted and it appeared that there is a brigade of social media entities, who indulge in insult mongering thereby leading to a possible ramification on communal harmony and is overall against the maintenance of public tranquility.”

“During investigation of the said case, Delhi Police had given status report, wherein the tweet by Mohammad Zubair was not found objectionable. Whereas, subsequent tweets after his tweet led to series of questionable and derogatory tweets. In the investigation of FIR no. 194/20, he had been earlier examined and the investigation is on the verge of conclusion,” the police added.

The police alleged that Zubair was evasive and was not cooperating in the investigation.
