The insight and practice domain of our civil lawyers extends to the following domains:
A lawyer must eye every claim as a weak case, until it is strengthened enough to win. Which is to say that there is no room for complacence. No matter how many times a matter of similar nature is handled by our civil lawyers, yet, every new case is diligently examined for its uniqueness by delving into the depths of factual details. Many desperate litigants approach B&B hoping to be represented by the best civil lawyers in Noida and we must stand up to their expectations. Ultimately, laying out the strongest possible recourse for our clients is our forte and our lawyers do not hesitate in traveling the extra mile for the clients.
Of hundreds of applications every month, the law firm selects a few Advocates who exhibit exemplary intelligence, deep knowledge of the law, good practice experience, a sense of righteousness, and service motive. B&B is home to some of the most capable and well-versed lawyers who come from various parts of the country to pursue their interest in litigation law in an organized, disciplined, and intellectual environment.
A lawyer’s mistake is suffered by the client!
If a law office is callous it will of course show in the result, but, by then the client would have lost everything. Therefore, it is important to maintain organizational discipline and work protocols so that no client suffers the fault of the counsel. B&B is immensely progressive with its litigation and lawsuit management systems which guarantee preparedness of counsels and attendance on every single date. The firm deploys periodic work reminders and client-communication protocols to make sure that all the legal works required in a case are done on time and the litigation is totally under command. Besides, even the courts are appreciative of well-read, punctual and prepared counsels. Instead of the traditional diary noting system, B&B uses an effective intranet system which is synced with all counsels of the firm and issues timely alerts about the priority of work.
At B&B Associates LLP, instead of vague assurances or false hopes, the focus is kept on ethical work and objectivity. The counsels provide genuine consultation as to the evaluation of rights and recourses and include foreseeable negative factors. Fair-dealings and disciplined work help the firm maintain healthy and long term and trust worth relation with the clientele.
No litigant should suffer injustice because of the callousness of lawyers. A legal exercise consumes an enormous amount of time and money, and an unfair result can burden a client and their family with irreversible losses. People often wonder if lawyers bring ill-repute upon themselves and the fraternity volitionally. In most cases, the answer is No. Truth is that even when some lawyers do not intend to cause a trouble/ damage to their clients, they end up doing so when they lack management skills and have poor management of time, priority, and resources at hand. Which is to say that knowledge of law and recourses is not the only factor. Office and lawsuit management is as crucial an aspect and needs an intellectual thought. Which is why B&B has protocols for proper office and lawsuit management. An efficient management makes sure that every lawsuit gets proper time and attention and the law firm functions smoothly.
A predetermined legal procedure applies to civil lawsuits as per the provisions of the Civil Procedure Code (CPC). While matters may appear complicated to the layman, as an eminent law firm, B&B Associates LLP prefers a client-centric approach and helps litigants to understand the procedural nuances thoroughly. The following are common stages.
The institution of the suit starts by filling a plaint in the civil court. The plaint shall contain a factual summary of the case which is filed by the plaintiff. The cause of action and the jurisdiction of the competent court shall be established. The plaint needs to have a specific spirit that leads to a certain and specific allegation on the defendant which can be corroborated by evidence. A plaint should not be vague or based merely on hearsay and the plaintiff should have a valid cause of action and bonafide interest in pursuing litigation.
A plaint is replied through a written statement submitted by the defendant. A written statement is an expression of rejection or acceptance of the averments made by the plaintiff in his plaint. A written statement needs to be carefully drafted with a para-wise reply, wherein, specific denial and acceptance is required. Also, it shall be ensured, that a mere denial of averments is not enough and facts which contradict/ rebut the averments shall be truthfully pleaded. Evidence regarding the same shall also be led.
Objection/ concerns against the written statement are to be timely presented by the plaintiff by way of filing the rejoinder.
The evidence is led by both sides as per the provisions of the Indian Evidence Act. The most ticklish yet the most important part of a lawsuit, evidence indeed requires a knowledgeable and expert civil lawyer to tactfully and wisely handle this stage of proceedings. The fate of a case entirely depends upon the evidence and how it is led by the parties. It is important to challenge the validity of the opposition’s evidence and statements and bring out any contradictions to the front.
A good advocate ensures that each piece of opposition’s evidence goes through certain tests of validity in law before it is accepted by the court as a valid evidence. This is the stage where efficient advocates sometimes have to guide the courts in the interest of justice to not accept as evidence something which stands invalid as per the laws of India and provisions of the Indian Evidence Act.
The stage of Arguments is when the matter is argued before the court by both the parties while emphasizing on the merit of their side and case. This is exactly where an extraordinary advocate with great oratory skills and courtroom tactics is valued. It takes nothing short of genius to bring out the best in a case and put it simply. As courts have limited time, it is important that the advocate delivers important points in a cordial manner and with absolute conviction. Our leading civil advocates in Noida have their arguments prepared, tried, and strategized beforehand to ensure that the client is strongly represented.
The final stage is reached where judgment and decree are passed by the civil law court. Based on the Statements, Evidence led and the arguments furnished by the learned counsels. Then the court weighs all factors in a case and reaches a point of decision which the court deems fit, proper and just.
Finally, the execution is filed to implement the order of the civil law court.
One might think at this stage that the process is over, however, this is where it has just begun. After the lower court, an appeal can be preferred before the District Judge. And then, a regular second appeal can be filed before the Hon’ble High Court, and, thereafter, a Special Leave Petition can be filed in the Hon’ble Supreme Court. The limitation for filing a suit should always be kept in mind.
